Спеціалізовані прокуратури у сфері оборони вживають заходів для притягнення винних осіб за до відповідальності за зловживання під час нарахування і виплати військовослужбовцям гарантованого державою грошового забезпечення. Дана категорії справ є одним із головних пріоритетів діяльності спеціалізованих прокурор, які координують роботу правоохоронних органів, здійснюють процесуальне керівництво досудовими розслідуваннями у таких категоріях справ.

Лише за останню добу в 20 кримінальних проваджень за фактами порушень під час нарахування та виплати військовослужбовцям грошового забезпечення повідомлено про підозру 23 особам, з них 7 осіб затримано. Серед фігурантів справ: два заступника командира військової частини, командир роти, головний бухгалтер військової частини та ін.

Сума завданих державі збитків у вказаних кримінальних провадженнях становить понад 34 млн грн., з них понад 25 млн грн це кошти, які  незаконного були нараховані та виплачені як «бойові». Насправді, особи, які отримували ці кошти не перебували на «нулі».

До прикладу, за процесуального керівництва Білоцерківської спеціалізованої прокуратури у сфері оборони до відповідальності за ч. 4 ст. 425 КК України притягнуто колишнього командира військового формування, який не забезпечив належного контролю за законністю виплати підлеглим додаткових винагород за участь у відсічі збройної агресії, внаслідок чого їм безпідставно нараховано кошти на загальну суму понад 15 млн гривень.

Також за процесуального керівництва Львівської спеціалізованої прокуратури у сфері оборони викрито організовану групу, до якої входили посадова особа фінансово-економічного відділу військової частини, а також офіцери та сержанти структурного підрозділу. Підозрювані безпідставно нарахували собі грошових виплат на понад 5 млн грн. 

Зазначеним особам повідомлено про підозру за ч. 5 ст. 191 КК України. Готуються клопотання про обрання запобіжних заходів. За вчинення протиправних дій винним загрожує від 7 до 12 років позбавлення волі з конфіскацією майна.

Крім того, завершено досудове розслідування у 7 кримінальних провадженнях стосовно 7 осіб за фактами зловживань з бюджетними коштами. Обвинувальні акти скеровано до суду.

Як зазначають прокурори спеціалізованої прокуратури у сфері оборони, «забезпечення законності в сфері оборони та притягнення винних осіб, які протиправно розпоряджаються бюджетними коштами, підвищує довіру військовослужбовців до державних інституцій».

Specialized Prosecutor's Offices in the Field of Defense exposed numerous facts of abuse during the calculation and payment of financial support to military personnel: more than UAH 34 million in losses to the state, of which more than UAH 25 million – are illegal «combat» payments

Specialized Prosecutor's Offices in the Field of Defense take measures to bring guilty persons to justice for abuses during the calculation and payment of state-guaranteed financial support to military personnel. This category of cases is one of the main priorities of the activities of specialized prosecutors who coordinate the work of law enforcement agencies, carry out procedural management of pre-trial investigations in such categories of cases.

Only in the last day, 23 persons were notified of suspicion in 20 criminal proceedings on the facts of violations during the accrual and payment of financial support to military personnel, of which 7 persons were detained. Among those involved in the cases: two deputy commanders of a military unit, a company commander, the chief accountant of a military unit, etc.

The amount of damages caused to the state in the specified criminal proceedings is more than UAH 34 million, of which more than UAH 25 million are funds that were illegally accrued and paid as «combat». In fact, the persons who received these funds were not at the front line.

For example, under the procedural supervision of the Bila Tserkva Specialized Prosecutor's Office in the Field of Defense, the former commander of a military formation, who did not ensure proper control over the legality of paying subordinates additional rewards for participating in repelling armed aggression, as a result of which they were unjustifiably accrued funds in the total amount of more than UAH15 million, had been brought to justice under Part 4 of Art. 425 of the Criminal Code of Ukraine

Also, under the procedural supervision of the Lviv Specialized Prosecutor's Office in the Field of Defense an organized group was exposed, which included an official of the financial and economic department of the military unit, as well as officers and sergeants of the structural unit. The suspects unjustifiably accrued themselves with cash payments of more than UAH 5 million.  

The above-mentioned persons have been notified of suspicion under part 5 of Art 191 of the Criminal Code of Ukraine. Motions for the imposition of preventive measures are being prepared. For committing unlawful acts, the perpetrators face from 7 to 12 years of imprisonment with confiscation of property.

In addition, the pre-trial investigation in 7 criminal proceedings against 7 persons on the facts of abuses with budget funds has been completed. Indictments were sent to trial.

As noted by the prosecutors of the Specialized Prosecutor's Office in the Field of Defense, «ensuring legality in the field of defense and bringing guilty persons who illegally dispose of budget funds to justice increases the trust of military personnel in state institutions».
