Thanks to the environmental prosecutors, two rates of 73 hectares in Odesa region were returned to the community. They were leased illegally

Based on the claims of the Odesa Regional Prosecutor's Office, two cases have been reviewed by the Supreme Court regarding the invalidation of lease agreements for the Krychunivskyi and Adamivskyi ponds and their return to the community's management.

These water bodies, with a total area of 73 hectares within the Lyubashivka village council in Odesa region, were illegally obtained by companies for fish farming purposes. The mandatory procedure for conducting an auction to determine the winner who would offer the community the most advantageous price was not followed. Consequently, land auctions for the transfer of the ponds for use were not held.

The court supported the prosecutors' position regarding the violation of the requirements of the Land and Water Codes of Ukraine, which regulate the transfer of water bodies and the land plots beneath them exclusively on a competitive basis.

At the same time, it refuted the defendants' arguments that the ponds are allegedly used solely for irrigation, which did not require conducting auctions.

As a result of the cassation review in both cases, the decisions of the lower courts were annulled, and new ones were adopted – satisfying the prosecutor's claims.
