Under the public prosecution of the Chernihiv Regional Prosecutor's Office, a serviceman of the armed forces of the Russian Federation was found guilty of issuing orders for the cruel treatment of civilians and violating the laws and customs of war (part 2 of article 28, part 1 of article 438 of the Criminal Code of Ukraine) and was sentenced to the maximum penalty provided by the article — 12 years of imprisonment.
Prosecutors proved that a captain of the Russian Armed Forces with the call sign "Klen" directed actions and issued orders to subordinates to detain 369 civilians, including 69 minors, in the basement of the Yahidnyanska school as a "human shield." As a result of inhumane conditions of detention and the failure to provide necessary medical assistance, 10 people died.
Thus, the residents of the village of Yahidne in the Chernihiv district were used to cover the command post from possible offensive actions by the Armed Forces of Ukraine.
In addition, the commander personally committed illegal acts against the victims. He forcibly drove people into the basement of the school and threatened them with murder.
The case was considered in accordance with special judicial proceedings. The special pre-trial investigation and operational support were carried out by the Security Service of Ukraine in the Chernihiv region.
