Prosecutors of the Kyiv City Prosecutor's Office have notified one of the leaders of the State Enterprise "Forests of Ukraine" of suspicion regarding negligence in the procurement of tractors.

It has been established that in 2023, the state enterprise "Forests of Ukraine" signed a contract with the winning company for the supply of 11 tractors after conducting a public procurement.

In reality, the technical specifications of the equipment purchased did not meet the requirements outlined in the tender documentation. The private company provided false information in its tender proposal to win the tender. At the same time, the seller's documents should have been verified, and their proposal should have been rejected.

Instead, the suspect did not verify the technical specifications of the tractors and signed the supply contract for the equipment. Subsequently, the official instructed the directors of the forestry branch to accept and register the tractors.

According to the conclusions of the expert examinations, the amount of damages caused by the purchase of equipment different from what was supposed to be procured exceeds 1.6 million hryvnias.

Currently, the official has been notified of suspicion, and the issue of choosing a preventive measure and suspension from office is being resolved.

The actions of the suspect have been qualified under part 2 of Article 367 of the Criminal Code of Ukraine, namely negligence, that is, improper performance of official duties by an official due to a negligent attitude towards them, which caused severe consequences for the state interests protected by law.

The sanction of the article provides for up to 5 years of imprisonment with deprivation of the right to hold certain positions or engage in certain activities for up to 3 years and a fine of two hundred fifty to seven hundred fifty non-taxable minimum incomes of citizens or without such.

The pre-trial investigation is being conducted under the procedural guidance of the Kyiv City Prosecutor's Office by investigators of the Main Directorate of the National Police in Kyiv with operational support from the DSR of the National Police of Ukraine.

Note: according to Article 62 of the Constitution of Ukraine, a person is presumed innocent of committing a crime and cannot be subjected to criminal punishment until their guilt is proven in a lawful manner and established by a guilty verdict of the court.
