The prosecutors of the Office of the Attorney General have sent an indictment to the court against the head of the cash operations department of one of the private banks under part 5 of Article 27, part 2 of Article 28, and part 1 of Article 218-1 of the Criminal Code of Ukraine for complicity in bringing the bank to insolvency by reducing the indicators of the minimum regulatory capital of the bank due to the absence of funds in the bank's vault totaling over 365.6 million UAH.

The investigation established that the founders of the private bank, in collusion with a group of individuals - including the head of the cash operations department of this bank and other unidentified persons, brought the bank to insolvency by reducing the indicators of the minimum regulatory capital of the bank due to the absence of funds in the bank's vault amounting to over 153.4 million UAH, over 5.7 million USD, and over 42.5 thousand euros.

Thus, the participants in the scheme for a long time issued funds to individuals and legal entities without formal documentation, reflected in the cash accounting documents information about cash receipts from the bank's clients, without the actual receipt of such funds, entered false information regarding cash balances in the bank's cash vault into audit reports, and submitted knowingly false information regarding the bank's financial condition to regulatory authorities.

The materials of the criminal proceedings regarding the suspicions against the founders of the bank for committing a criminal offense under part 2 of Article 28 and part 1 of Article 218-1 of the Criminal Code of Ukraine have been separated into a separate proceeding and suspended due to their being placed on the international wanted list.

The pre-trial investigation in the criminal proceedings was conducted by detectives of the Main Unit of Detectives of the Bureau of Economic Security of Ukraine.

Note: according to Article 62 of the Constitution of Ukraine, a person is presumed innocent of committing a crime and cannot be subjected to criminal punishment until their guilt is proven in a lawful manner and established by a guilty verdict of the court.
