The prosecutor's office through the court returned the land on the banks of the Dnieper to the territorial community with a value of over UAH 1.3 million

The Svidivets Village Council has leased a land plot on the banks of the Kremenchuk Reservoir of the Dnipro River to the cooperative for 49 years for development, along with swamps, part of the floodplain, and the protective coastal strip of the reservoir. 

The village council transferred the plots in violation of land and water legislation: such lands have a nature conservation purpose and can only be used for the preservation of water resources, protection against pollution, and flooding. 

The land and technical expertise confirmed that the development of the plots contradicts the legislation, and the construction works have caused violations of the hydrological regime of the coastline and threaten the ecological state of the Dnipro River.

The appellate court agreed with the arguments of the prosecutor's office and upheld the decision of the Cherkasy District Court: the cooperative must return to the communal property of the territorial community of the village of Svidivok the land plots of the water fund with an area of almost 4 hectares and a value of over 1.3 million UAH.

The prosecutor's office of Chernihiv region is taking systemic measures to ensure the effective use of land and water resources. 

This year, this is already the second case where illegal use of water fund lands on the banks of the Dnipro River has been terminated following lawsuits from the prosecutor's office.
