In the Kyiv region, a lawyer was exposed to a scheme of forgery for illegal delay from mobilization

The Kyiv Specialized Prosecutor's Office in the field of defense of the Central region, together with the Main Directorate of the Security Service of Ukraine in Kyiv and the Kyiv region, has reported suspicions against three lawyers and three of their assistants who facilitated evasion from mobilization of military conscripts by producing forged disability documents.

According to the investigation, the criminal organization of lawyers and their assistants created a closed community in Telegram for the production and sale of forged medical certificates of disability of the II group. These documents were used to obtain deferments from mobilization and to exempt servicemen from duty during martial law. 

The cost of the forged certificates was 5–10 thousand euros, while legal support and document processing at the TCC and SP cost 1.5 thousand euros. Payment was made in cash, via bank transfers, or in cryptocurrency. 

Numerous cases of illegal deferments have been documented, including through the forgery of MSEC certificates of disability or care for a supposedly disabled person from the family of the military conscript.

The participants of the criminal organization have been exposed and detained, and preventive measures have been chosen for them.

The actions of the individuals have been qualified under parts 1, 2 of Article 255, part 2 of Article 28, part 1 of Article 114-1, part 5 of Article 27, Article 336, part 5 of Article 27, part 4 of Article 409 of the Criminal Code of Ukraine.

The suspects face a punishment of imprisonment for up to twelve years with confiscation of property.

Note: according to Article 62 of the Constitution of Ukraine, a person is presumed innocent of committing a crime and cannot be subjected to criminal punishment until their guilt is proven in a lawful manner and established by a court verdict.
