The ecological prosecutor's office appeals the reconstruction agreement on the territory of the National Botanical Garden named after M.M. Grishka

The Economic Court of Kyiv is considering a lawsuit from the Specialized Environmental Prosecutor's Office of the Office of the Prosecutor General against the National Botanical Garden and a private company. The prosecutors demand that the contract, which creates a risk of illegal alienation of state property and protected lands, be declared invalid.

This concerns nearly 130 hectares of the natural reserve fund and a national significance monument of garden and park art. In 2018, the management of the garden signed a contract with a private company for the reconstruction of real estate objects. According to its terms, after the reconstruction, most of the area was to be transferred to the ownership of the company, which would effectively mean the loss of part of the state land and property.

Currently, the reconstruction of the objects has not begun. The illegality of the concluded contract was emphasized by the State Audit Office of Ukraine during a financial audit of the National Academy of Sciences of Ukraine.

From 2019 to 2022, the garden received over 2.4 million hryvnias from the company. The prosecution insists that the contract was concluded in violation of the law and contradicts state interests. Therefore, it asks the court to declare it invalid and to recover the funds received for the state’s revenue.
