$ 10,000 for a fictitious employment for the purpose of giving a reservation from conscription

The Specialized Prosecutor's Office in the Defense Sector of the Central Region, together with the Main Directorate of the National Police in Kyiv, with the operational support of the Strategic Investigations Department of the National Police of Ukraine and with the assistance of the Ministry of Defense of Ukraine, has reported suspicion against an employee of the Ministry of Defense for committing a criminal offense under Part 5 of Article 27 and Part 3 of Article 368 of the Criminal Code of Ukraine (aiding a public official in receiving unlawful benefits).

According to the investigation, the suspect promised to assist in the removal of conscripted men from military registration and their subsequent reservation by means of fictitious employment at an enterprise that has the status of critically important.

In particular, for a monetary reward of 10,000 US dollars, he offered to facilitate the entry of information into the "Reserve+" system for the issuance of a deferment from conscription under the guise of official employment relations with such an enterprise.

After providing the conscript with a reservation and receiving an unlawful benefit of 10,000 US dollars, the perpetrator was detained in accordance with Article 208 of the Criminal Procedure Code of Ukraine, and the subject of the unlawful benefit was seized.

He has been chosen a preventive measure in the form of detention with the possibility of posting bail.

Measures are being taken to identify and hold accountable other individuals involved in the crime.

The sanction of the incriminated article provides for punishment in the form of imprisonment for a term of five to ten years, with deprivation of the right to hold certain positions or engage in certain activities for up to three years, along with confiscation of property.

Note: according to Article 62 of the Constitution of Ukraine, a person is presumed innocent of committing a crime and cannot be subjected to criminal punishment until their guilt is proven in a lawful manner and established by a guilty verdict of the court.
